ADT Solar Contract Exit Options for Homeowners

Table of Contents

You can cancel an ADT solar contract within 3 business days of signing under the FTC Cooling-Off Rule (16 CFR Part 429). After that window, legal exits exist through misrepresentation, breach of contract, TILA violations, and the FTC Holder Rule, but you need documented evidence. ADT Solar exited the residential market in early 2024, which creates additional legal leverage for affected homeowners.

The ADT Solar Story: Why So Many Homeowners Want Out

ADT Inc. entered the solar market in November 2021 by acquiring SunPro Solar for a reported enterprise value of roughly $825 million. SunPro was rebranded as ADT Solar and expanded across Atlanta, Houston, Chicago, Phoenix, Miami, and other major markets.

The pitch to homeowners was a compelling one: a trusted household security brand, now offering solar with 25-year warranties on workmanship, equipment, and power production.

It fell apart fast.

By November 2023, ADT closed 22 of its 38 branches. By January 24, 2024, ADT officially announced it would exit the residential solar business entirely. The solar segment recorded an adjusted EBITDA loss of $89 million through the first nine months of 2023 alone, according to company financial disclosures.

Revenue from the solar division dropped 68% in Q3 2023 compared to the same quarter the year before.

ADT Solar is now marked “out of business” on multiple BBB location profiles across the country. BBB records show 948 total complaints filed against ADT Solar in the last three years, covering installation failures, broken warranty commitments, communication collapse, and misrepresented savings.

Lenders who hold ADT Solar loan portfolios have since pushed ADT back into limited operations to protect their financial exposure. But that re-entry does not resolve the situation for the thousands of homeowners left with non-performing systems.

What ADT Solar Customers Are Actually Reporting

  • Systems reportedly produce far less energy than promised, with some homeowners claiming zero output while still making monthly loan payments.
  • Warranty and repair complaints involving roof leaks, failed microinverters, and long delays with no clear resolution timeline.
  • Customers alleging promised savings never materialized, leaving them paying both high solar loan payments and large electricity bills.
  • BBB complaints stated that ADT representatives later described door-to-door solar salespeople as third-party contractors rather than direct employees.
  • Multiple reviews describe poor post-installation support, delayed communication, and difficulty getting service issues resolved after the system was installed.

Your Right to Cancel ADT Solar Contract: The 3-Day Window

The federal FTC Cooling-Off Rule (16 CFR Part 429) applies to any contract signed in your home. Most solar sales happen exactly this way: a salesperson at your door or your kitchen table.

That means you have three business days from the date you signed to cancel with no penalty and no explanation required.

ADT was legally required to give you two printed cancellation forms at the signing. If they failed to provide those forms, the three-day clock may never have started. That is not a technicality; courts have upheld this. The cancellation window extends until the required notice is properly provided.

How to Exercise This Right

Send a written cancellation notice to ADT Solar via certified mail with a return receipt requested. The postmark date controls, not the delivery date. In your letter, state your name, the address of installation, the contract date, and that you are canceling under the FTC Cooling-Off Rule (16 CFR Part 429).

Keep a copy. Send a backup via email with delivery confirmation.

ADT is then required to cancel any financing documents tied to the agreement and return your money within 10 business days. If a UCC-1 lien was placed on your property title, that must be removed.

State-Specific Protections Worth Knowing

California

California Civil Code §1689.7 (the Home Solicitation Sales Act) mirrors the federal rule but adds a key protection: ADT was prohibited from beginning any installation work before the three-day cooling-off period expired.  If work started before that window closed, they violated state law.

California seniors aged 65 and older get five business days rather than three under AB 2471. If ADT failed to place the required cancellation notice on the face of your contract in bold 10-point type, California courts have interpreted §1689.7(g) as extending your right to cancel indefinitely until proper notice is delivered.

That interpretation comes directly from California appellate case law applying the Home Solicitation Sales Act. Complaints can be filed with the California Contractors State License Board at cslb.ca.gov, and ADT held a CA license #1080382 during its operational period.

Texas

Texas Business & Commerce Code §601.052 applies to door-to-door solar sales and gives buyers the same three-day cancellation right. Section 601.053 requires the seller to provide a written cancellation notice, and failure to do so extends your window.

As of September 2025, Texas TDLR now requires residential solar retailers to register with the state and follow specific consumer protection requirements under the new Residential Solar Retailer Program.

Texas homeowners can file DTPA complaints with the Texas Attorney General at texasattorneygeneral.gov/consumer-protection.

ADT Solar Contract Cancellation After Installation: Your Legal Grounds

The cooling-off window is closed for most ADT Solar customers as installation happened months or years ago. That does not mean your options are gone. Post-installation cancellation requires identifying a specific legal basis and building documented evidence to support it.

1. Misrepresentation: The Most Commonly Viable Claim

When a salesperson told you your bills would drop to near zero, that your system would produce enough to cover 100% of your electricity needs, or that your monthly total cost would be a specific number, and none of that happened, that is actionable misrepresentation.

The key is documentation. Pull every email, text, and proposal document from the sales process. Compare what was projected to what your utility bills show. Courts have consistently ruled that oral promises made during a sales presentation count as evidence, particularly when they also appear in proposal documents, energy estimates, or emails.

ADT salespeople frequently presented written production estimates to justify the loan amount. When those estimates turn out to have been generated using unshaded satellite data that ignored obvious roof obstructions or tree coverage, the underlying promise becomes indefensible.

2. Breach of Warranty

ADT’s contracts promised 25-year workmanship warranties and 25-year power production guarantees. When ADT exited the market and left systems non-functional with no repair pathway, those warranty obligations became breached.

Document every service request, every non-response, every referral to a third party, and every bill you paid to the utility company while your panels produced zero. That paper trail becomes the foundation of a breach of warranty claim.

ADT has been documented offering small cash settlements in exchange for legal releases, such as a tactic that is designed to strip homeowners of future warranty claims. Do not sign any settlement or NDA without legal review.

3. TILA Violations and Extended Rescission Rights

The Truth in Lending Act (15 U.S.C. §1635) requires lenders to clearly disclose the annual percentage rate, total finance charge, and amount financed before you sign. Solar loan agreements frequently contain “dealer fees” that are baked into the loan principal but never disclosed as a separate finance charge.

When those fees improperly inflate the amount financed, it creates a TILA violation. A TILA violation extends your right to rescind the loan for up to three years from the date of signing, a federal right that does not expire with the cooling-off window.

4. The FTC Holder Rule: Pursuing Your Lender Directly

Because ADT Solar is out of business or minimally operational, many homeowners assume they have nowhere to turn. The FTC Holder Rule (16 CFR Part 433) changes that.

This federal rule, described by the FTC as one of the commission’s most important consumer protection actions, requires that consumer credit contracts contain a specific notice making the lender subject to all claims and defenses the buyer has against the seller.

In plain terms: if ADT Solar misrepresented your agreement, you can bring those same claims directly against the lender who holds your loan — whether that is Goodleap, Mosaic, Sunlight Financial, or another servicer.

Look for this language in your loan contract: “ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER.”

If that notice is present, you have a clear legal basis. If it is absent, that absence may itself be a violation of FTC rules. This is another ground for legal action.

Recovery under the Holder Rule is limited to the total amount you have already paid toward the loan, plus the outstanding loan balance. For separate damages like roof leaks or property damage, those claims go against ADT Solar as the installer, not against the lender.

The Specific Problem of ADT Solar Contracts Signed Under SunPro

A significant number of homeowners signed contracts with SunPro Solar before ADT acquired it. ADT assumed those contractual obligations when it acquired the company in November 2021.

Many of those homeowners report they were never notified that SunPro was acquired by ADT. It is a failure that was itself raised in multiple BBB complaints.

If your contract is a SunPro contract and ADT Solar subsequently failed to honor warranty terms, that breach of inherited contractual obligations is actionable against ADT. The acquisition does not insulate ADT from the obligations it assumed at the time of purchase.

Documenting Your Case Before You Contact Anyone

Before reaching out to ADT, your lender, or an attorney, build your evidence file. What you say in writing to these parties affects your legal position.

Collect the following:

  • Your original installation contract (the ADT or SunPro agreement)
  • Your financing agreement and all loan statements
  • Your original sales proposal and energy production estimate
  • At least 12 months of utility bills before and after installation
  • Every email, text, and service ticket since installation
  • Screenshots of your monitoring app showing production history
  • Any written communications from ADT referencing warranty claims or service requests

Do not contact ADT or your lender with complaints until you have assembled this file and, ideally, had it reviewed by a solar contract attorney. Offhand complaints without legal framing can undermine your position.

ADT Solar Contract Dispute Resolution: Where to File Complaints

Filing with state and federal agencies is free, creates an official paper trail, and puts institutional pressure on ADT and its lending partners.

Agency What to File Where
FTC Deceptive sales practices, Cooling-Off Rule violations reportfraud.ftc.gov
CFPB Lender disclosure violations, TILA claims consumerfinance.gov/complaint
California AG CLRA violations, CSLB contractor complaints oag.ca.gov
Texas AG DTPA violations texasattorneygeneral.gov/consumer-protection
BBB General service complaints, warranty failures bbb.org
State AG (all states) Consumer fraud, deceptive trade practices Your state AG website

A pattern of official complaints against a single company creates the kind of documented record that strengthens private legal action and can trigger a regulatory investigation.

What ADT Solar Contract Cancellation Actually Costs

Within the 3-day cooling-off window: Federal law entitles you to a full refund and cancellation of any financing documents. ADT has 10 business days to comply.

Outside the cooling-off window:

  • Attorney-led legal review and representation is often available on a flat fee or contingency basis
  • Loan buyouts through your lender, if pursued directly, typically run $10,000 to $40,000, depending on system size and remaining loan term
  • Panel removal after cancellation costs approximately $3,000 to $8,000

Frequently Asked Questions

Can you cancel an ADT solar contract after installation?

Yes, through misrepresentation, breach of warranty, TILA violations, or FTC Holder Rule claims against your lender. Each route requires documented evidence. A free attorney review of your contract is the fastest way to identify which basis applies to your situation.

Does ADT Solar’s shutdown affect my ability to cancel?

It actually strengthens your position. ADT’s failure to maintain warranty service and the company’s documented exit from the market are themselves evidence of breach. The FTC Holder Rule also lets you pursue claims directly against your lender if ADT is unreachable or unresponsive.

What is the cost to cancel an ADT solar contract?

Within the 3-day window: zero cost, full refund. Outside that window: costs vary from flat-fee attorney services to lender buyouts ranging from $10,000 to $40,000. Signing ADT’s settlement offers without legal review often results in giving up far more than you receive.

What if I originally signed with SunPro Solar, not ADT?

ADT assumed SunPro’s contractual obligations when it acquired the company in 2021. If ADT failed to honor those obligations, particularly warranty service, you have breach of contract claims against ADT as the successor company.
